Legal Requirements for Marrying in Australia
The law requires that you sign and lodge with me the Notice of Intended Marriage before you are legally able to marry. This must be submitted to me a minimum of one calendar month and one day before the wedding or 18 months prior.
The legal marrying age in Australia is 18.
You must provide proof of age and identity in the form of a birth certificate in English. If born outside Australia you can provide a passport or birth certificate from your country of birth.
If either of you have been married before, you must produce your Divorce Decree Absolute paper. If either of your spouses is deceased, you need to produce the Death Certificate.
You must have two witnesses over the age of 18 on your wedding day.
